What Is a Layout Design of an Integrated Circuit? 

A layout design (also known as a topography) refers to the three-dimensional configuration of electronic circuits used in microchips and semiconductor devices. This includes the specific arrangement of transistors, resistors, and interconnections on or within a semiconductor chip.

To be eligible for protection, the layout design must be: 

Original, not commonplace in the semiconductor industry 

Independently created by the applicant 

Commercially exploited for the first time within two years of the application 

Once registered, protection lasts for 10 years, starting from the earlier of the date of first commercial use or the filing date.

Step-by-Step Process to Register an Integrated Circuit Layout Design: 

Step 1: Ensure Eligibility

Your layout must be original, not commercially exploited for more than 2 years, and created through your own effort.

Step 2: Prepare Your Application:

Your application should include: 

  • A completed application form 
  • A representation or drawing of the layout design 
  • A brief description of the design 
  • Date of first commercial exploitation (if applicable) 
  • The prescribed application fee 

Step 3: Submit the Application

Deliver your application and supporting documents to the Intellectual Property Office. Submissions can be made in person or by mail. 

Step 4: Formal Examination

The IPO will examine the application to ensure it meets all legal requirements. 

Step 5: Examination & Publication

The IPO examines your application. If accepted, it is published in the Trade Marks Journal for opposition. 

Step 6: Registration & Protection

Once approved, your layout design will be registered and protected under law for a period of 10 years.
