Workers' Rights


The Labour Inspectorate Unit of the Ministry of Labour and Small Enterprise Development ensures that both employers and employees are aware of the rights and responsibilities, respectively. Workers' rights are protected by law in Trinidad and Tobago.  Some of these rights include minimum wage, hours of work, payment of overtime rates, meal and rest breaks, vacation leave, sick leave, and maternity benefits. Clarification on the rights of workers according to the terms and conditions of work and the relevant legislation can be sought at the Labour Inspectorate Unit of the Ministry of Labour and Small Enterprise Development.

 




Employer’s Obligation to Employees

The Labour Inspectorate Unit of the Ministry of Labour and Small Enterprise Development is responsible for the enforcement of the following legislation:
  Minimum Wages Act 1976, as amended.
  Minimum Wages Order, 2014.
  Minimum Wages (Catering Industry) Order, 1991.
  Minimum Wages (Shop Assistants) Order, 1991.
  Minimum Wages (Household Assistants) Order, 1991.
  Minimum Wages (Security Industry Employees) Order, 1995.
  Minimum Wages (Petrol Filling Station Employees) Order, 1982.
  The Wages Regulations (Agricultural Undertakings) Order, 1964
  The Wages Regulations (Laundry Undertakings) Order, 1962
  Maternity Protection Act 1998.
  Children Act 2012 (Part XIV)
 
The Unit provides assistance to employers to ensure compliance with the minimum wage, terms and conditions of employment, maternity protection and the employment of young persons.

How do I make a complaint?

Prior to filing a complaint with the Labour Inspectorate Unit, you may write to your employer, describing the infringement and asking your employer to comply with his or her legal requirements. However, if the employer refuses to comply or you prefer to talk to a Labour Inspector you should contact the Labour Inspectorate Unit of the Ministry of Labour and Small Enterprise Development by telephone or walk in to any of its offices listed below to file a complaint.

You would be interviewed by a Labour Inspector, who would complete an official complaint form that captures information about you and your employer:

  The name of the business.
  The owner of the business.
  The address and telephone number of the business
  Your name.
  Your address and telephone number.
  Your position in the business.
  Any other information relevant to your complaint.

How are complaints processed?

Once your complaint is received:

  1. The Supervisor would assign the complaint to an Inspector for investigation to ascertain breaches identified.
  2. The findings of the investigation would be communicated to you, the complainant, and the employer.
  3. If it is determined that your rights were infringed, then your employer would be given a reasonable time frame within which to correct the breaches.  Failure by your employer to comply could result in the dispute being referred to the Industrial Court for determination.

How much does it cost?

There is no charge to make a complaint or to have a complaint investigated. Our services to workers and employers are free.
